According to Phoenix Police Department Spokesman Sergeant Steve Martos, twenty-year-old Angelo Wright died after a car attempted to turn left in front of him while he was riding his motorcycle. The accident occurred on Wednesday at approximately 4 p.m. at the intersection of Cave Creek Road and Union Hills Drive. According to Sergeant Martos, Police responding to the accident were told that the motorcyclist was injured and his bike was on fire. At the scene of the accident, Police learned that the eighty-four-year old female driver of the vehicle, a Volkswagen Rabbit, failed to yield to Mr. Wright causing the collision. Mr. Wright was transported to a local hospital and later died from his injuries. At the personal injury law firm Beauchamp Law Office P.C., we understand that the aftermath of a car accident can be incredibly stressful. As the weather heats up, we are reminded that pool season is just around the corner and hopefully also reminded of the importance of teaching our children about water-safety. On May 31st, 1998, Ms. Druann Letter’s three-year-old son Weston drowned in their backyard swimming pool at their home in Gilbert. As a teacher at Kyrene del Cielo Elementary School, Ms. Letter very quickly became determined to see good come from her tragedy. Ms. Letter said, “At Weston’s funeral, one of my first-graders came up to me and said ‘Mrs. Letter, if I was there I would have jumped in and saved Weston.” According to Ms. Letter, “That was kind of the spark that started it. Is that really what they would do? We did a study at our school and found out that people know very little about water safety and what to do to be safe. That’s how Water Watchers was started.” Water Watchers, the organization created by Ms. Letter, delivers a simple yet important message to keep children safe around water, called the ABC’s of water safety. The organization, which has been adopted by Phoenix Children’s Hospital, held its annual Water Safety Day on Tuesday at South Mountain Community College. The…

Accident

According to Police, twenty-two-year-old Anthony Ray Chavez, a former Marine, died early Sunday morning when his motorcycle crashed into the back of an SUV. The accident, which occurred on Warner Road, in Chandler, threw Mr. Chavez’s motorcycle into a light pole and Mr. Chavez a lengthy distance away from his bike. According to Chandler Police, Mr. Chavez was riding at least 90 mph and was likely impaired at the time of the accident. There were three adults in the SUV at the time of the accident, but they were not injured. According to Police, the driver of the SUV was not speeding at the time of the accident and did not appear to be impaired. Under Arizona law, all persons operating a motor vehicle must carry liability insurance. Liability insurance does not protect the person at-fault for the accident. Rather, liability insurance protects the other parties involved in the accident. Although Arizona law requires motorists to carry insurance, the injured party may not file a lawsuit directly against the at-fault motorist’s insurance provider. Further, in a personal injury lawsuit, the jury is not even allowed to know whether the defendant has insurance coverage. Finally, a defendant will be required…

According to the Phoenix Police Department, forty-three-year-old Kirk Jarvis died from injuries he received when he was struck by a vehicle while riding his motorcycle. The collision occurred on Tuesday at approximately 6 p.m. at 17th Avenue and Pecos Road when a sixty-one-year-old woman driving a 2007 Audi failed to yield at a stop sign. According to Police Spokesman Tommy Thompson, Mr. Jarvis, who was wearing a helmet at the time of the accident, was transported to the hospital where he was pronounced dead. The woman, whose name was not released, was not injured. Police do not believe impairment was a factor in the accident. Even if the state does not file criminal charges against the driver here, the victim’s family may choose to file a wrongful death lawsuit against the driver of the vehicle if the investigation reveals that the accident was a result of her negligent actions. Although a wrongful death lawsuit will not bring back a loved one, compensation from the suit may cover the victim’s medical bills and funeral expenses. A wrongful death lawsuit may also bring the family closure by holding the negligent driver responsible for her actions. If you have been injured in a car accident, contact the…

Department of Corrections Van Accident

tire blowout

On the morning of April 5th, ten people were injured in an accident on Interstate 10 when a tire blew out on their vehicle causing it to roll. The accident occurred on the Interstate 10 approximately five miles south of Riggs Road. The van was carrying nine Department of Corrections Officers (DOC) who were returning to their homes after working at the Eyman Arizona State Prison Complex in Florence. According to Officials, none of the passengers suffered life-threatening injuries. According to Bill Lamoreaux, spokesman for the Department of Corrections, the DOC has 92 vans driven by DOC staff members operating a vanpool program throughout Arizona. The accident is still under investigation by the Department of Public Safety. Reports do not indicate whether the Department will be held liable for improperly maintaining the van. Oftentimes, groups of people going to the same destination choose to travel together. A common vehicle chosen by large groups of people is the 15-passenger van.  Travelling together, as opposed to each individual travelling separately, may reduce the risk of car accidents. But, accidents involving 15-passenger vans do occur. According to the National Highway Transportation Safety Administration, more than 100 people die each year in 15-passenger van accidents. Of these accidents, more than…

Teen-Driver Accident Rate

Distracted Driving

Normal 0 false false false EN-US JA X-NONE According to the Arizona Department of Motor Vehicles, 50 percent of teenagers who recently obtained their drivers license are involved in a car accident within their first year of driving. Many of these accidents are the result of texting while driving. In fact, teenagers are twenty-six times more likely than their parents to send a text message while driving, and generally read or send at least one text every time they get behind the wheel.  The result: an overall increase in teen driver fatalities. To reduce the rate of teen accidents, a local automotive expert is conducting a free car-care clinic to first-time drivers to encourage safe driving.  One of the focuses of the clinic is text-free driving but also includes stories of teen accident fatalities from a Banner Health ER Nurse Manager. The clinic also teaches teens to avoid distractions such as eating, drinking or talking to other passengers while driving. Finally, the clinic teaches teens basic vehicle maintenance such as changing the vehicle’s oil or tires and how to be prepared for and handle an emergency…
